Conceptual and Legal Approaches to Mental Health

Module Aims

You will be able to distinguish between different conceptual and legal approaches to mental health and apply these approaches to case studies and legal outcomes with the aim of developing a critical and reflective approach to practice.  This will also involve constructing an understanding of the inter-linkage between the conceptual and the legal, through the course of history, in the field of mental health.

Outline Syllabus

The module includes an introduction to the libertarian, individual growth, medical and legal approaches to mental health and how these influence the diagnosis, treatment and legal approaches of it.  By applying these approaches to particular issues in mental health such as schizophrenia, depression and personality disorder, you will critically examine a range of contemporary treatments that have developed throughout history. An analysis and evaluation of approaches to mental health in criminal law, such as in the detention and questioning of suspects, the role of the appropriate adult and some of the full and partial defences that are available to defendants will be discussed in the light of the outcomes of relevant legal cases
