1 There shall be a students' association of the University which shall be the University of Bradford Students' Union (hereinafter called the 'Union').
2 In accordance with Section 22 of the Education Act 1994 the Council of the University shall prepare, issue and maintain a Code of Practice setting out arrangements for observance of the requirements of the Act relating to Students' Unions. The Code of Practice shall be drawn to the attention of all students annually together with the requirement that the Union shall incur no expenditure, and take no other action, which is inconsistent with the law relating to charities.
3 The Union shall have a written constitution which shall be subject to the approval of the Council of the University and to review by that body at intervals of not more than five years.
4 The objects of the Union shall be:
i) To promote the general interests and welfare of the students of the University.
ii) To provide the principal representative channel of communication between the student body and the University authorities and other bodies.
iii) To foster the cultural, intellectual, social and athletic recreations of the students of the University.
5 The members of the Union shall be:
i) All registered students of the University except those who exercise their right under the Education Act 1994 to opt out of membership.
ii) Such persons as the Union in accordance with its Constitution may from time to time admit as Associate, Life, or Honorary Members.
6 Members under 5(ii) other than Honorary Members will be required to pay such subscriptions as may be required by the Regulations of the Union.
7 The Union Council shall prepare Regulations for the furtherance of the objects of the Union which shall provide, inter alia, for General Meetings of the Union, for the election by secret ballot to the major Union offices, for the appointment of all necessary committees, for the constitution of and the fair allocation of resources to Union clubs and societies, for the proper internal control of the Union's financial affairs, and for the publication of an annual report and accounts.
8 Regulations and any alteration or abrogation thereof shall be of effect and binding on all members of the Union upon receiving the approval of the Council of the University after consultation with the Senate. Except for those Regulations expressly specified in the Constitution or the Code of Practice as requiring the approval of the Council of the University, the Council of the University after consultation with the Senate shall state which other Regulations may be altered or repealed by the Union Council without reference to the Council of the University.
9 The financial and general affairs of the Union shall be managed and administered by the Union Council and the Executive in accordance with the Code of Practice and the Constitution. In particular, the Union shall prepare a budget for approval by the Council of the University, shall prepare periodic reports of income and expenditure as the Council of the University may require, and shall prepare annual accounts audited by auditors approved by the Council of the University. The annual accounts shall be presented to the Council of the University and made available to all students; and shall include a list of the external organisations to which the Union has made donations in the period covered by the accounts and details of such donations.
10 There shall be an Honorary Treasurer of the Union who shall be a member of the academic or administrative staff of the University and who shall be appointed by the Council of the University after consultation with the Union Council. The responsibilities of the Honorary Treasurer shall be set out in the Code of Practice.
11 No person shall hold sabbatical office or paid elected office in the Union for more than two years in total.
12 The Union shall publish annually a list of external organisations to which it is affiliated together with details of associated fees, donations and subscriptions. This list shall be reviewed and approved annually by the members of the Union. Full details of decisions to make new affiliations shall be announced by a notice published by the Union and made available to all students and to the Council of the University.
13 Not more frequently than once in any academic year a requisition of 4% of the members of the Union under 5(i) above may be made for a ballot on the continuation of affiliation to any specified external organisation.
14 The Code of Practice shall include procedures for the consideration of complaints by students (whether members or not) who are dissatisfied in their dealings with the Union or who claim to be unfairly disadvantaged in consequence of having opted out of Union membership. Complainants shall have a right of appeal to an independent person appointed by the Council of the University.
